  • Civil Enforcement Ltd Claim

    Hi,

    I received a PCN from CEL in August 2020. I had photo evidence sent to me from APNR cameras suggesting I had overstayed my allowed time in a free car park, 3 hours and 30 minutes in total. I do not recall staying that length of time in the car park although I may have visited it twice in that time period. I did not appeal and have chosen to ignore all their correspondence as I believed them to be "Car Park Cowboys" that use the usual bullying tactics. I have now received a court claim for inflated fees of £278.29. I have acknowledged the claim and have said that I intend to defend all of the claim. How realistic is it for me to win in court and what is my best course of action?

      This is a classic double dip case. The first exit and second entry have been "lost". Can you show you were elsewhere during the relevant period?

        Thank you for your response.

        I probably can't prove I was elsewhere, I thought by ignoring all their correspondence they would finally give up.

        However I will continue with the defence and will see where it takes me. I have attached the Claim Form with the 'Particulars of Claim' information, please can you help me with what documents I need to request on the CPR 31.14 form. What date do I use for filing my defence?

        Do I need to request anything else?

          Details of the parking charge, PCN, and the signage that allegedly created the contract.

          They have claimed £35 for court fees. I think it should be £25. Why are they claiming more ?

          Suggest you remove the password from your posted claim form

          You acknowledge on day 5, or shortly after, the issue date. This gives you 33 days from the date of issue to get your defence to the court.

          SAR to CEL

          Edit: It's £35 if done the old fashioned paper way but if the have used MCOL then it's still £25. Is this from Northampton?

                So mention in your defence that they appear to have exaggerated their costs. Just to cast doubts on the rest of their statements

                  I requested the information from Civil Enforcement Ltd by recorded delivery on 7th June but I have yet to hear back from them.

                  I am about to enter my defence particulars to the court of and I will quote the excessive amount case that you sent me previously and that the court fees claimed seem to be too high.

                  Do I mention that CEL have not responded to my request for the PCN and Agreement too?

                  Is it worth me mentioning that I visited the car park twice in that period but do not have evidence to back that up?

                    Did you send the CPR 31.14 request? If so then mention it.
