  • Bw Ĺegal county court claim

    My wife has received CC summons from BW legal for contravening the T & C s in a B & Q carpark.

    We ignored their letters until she received the summons for £208.


    We advised the court that she did not break the T & C's.

    It is almost 4 weeks until the hearing , they have offered her a discount of 25 % ,in order to settle.
    She refused this and offered £40 without prejudice and informed them that she will attend the hearing.

    1. They have many T&C's, can she rely on the fact that they are not being specific about which T&C that she contravened ?

    2. Will they actually attend the hearing for this amount ?


    3. I was actually driving the car at the time of the alleged contravention, my wife was not present.

    Any advice would be appreciated.

    It's not a summons, it's a claim

    First of all you don't say who was driving, though at this stage it does not matter but if they lose they may come after the driver.

    So what did the original PCN form say? Even post up a redacted copy leaving the dates.

    If all she has put in her defence is that she did not break the T&Cs I'm afraid that might not go very far as a defence.

    They will send a local rep to the hearing
