My parents took out some Sunterra points in 2005 which they cancelled that year. They had a finance agreement that is now imposed on their property as a charge.
These points were mis sold but the finance agreement stands.
What can be done in this instance?
I believe the Financial Ombudsman is our only hope but how could this be resolved.
The debt was sold to Link finance and when this was done they took my parents to court without their knowledge and had a CCJ.
We are investigating the points as they were cancelled but didn't get paid for them?
We are thinking our only hope is to get a lawyer to take the finance company to court on the fact the goods were mis sold and as we never had the "goods" this breaks the contract. My mother does remember phoning Sunterra within the 14 day period and said they didn't want to pursue, however I believe this wasn't done in writing until 6 months later.
