Looking for advise a homeowner has erected a gate at back og garden to allow their dog to leave the garden to foul in the farmers land behind. When approached the dog owner stated its ok as I don't have to clean it up as its on agricultural land. The land is used for grazing dairy cattle and cows in calf and dog muck can be cause of cows aborting their calves can anyone advise. The are crossing farmland boundary so they don't have to clean up the dog mess in their garden

If they are allowing their dog to run free where there is livestock they can be treated as a trespasser.
If the land is not included in the Countryside and Rights of Way Act 2000 as land to which the public have the right of access they are trespassing.
If this is your land IMO there is no reason why you should not fence off that persons garden so they do not have access.
May possibly be a cheaper and longer lasting solution than legal action for trespass
