  • Bank smart issuing small claims

    Good Morning

I hope you can help me as I have never been in this situation before and am struggling to know what to do. I have just read an old thread on your website regarding a company called Bank Smart which is the company who are issuing a claim against me for unpaid fees regarding a settled PPI claim.

It is a similar situation to the thread in that over the years they have bombarded me with endless letters/forms which to start with I did return as have found letters which I have marked to say I have responded but it just seemed very repetitive as more kept coming so that like the person in the thread I completely lost track.

The one difference is that they say I signed 2 agreements with them...one in 2012 and then another one in 2015 which they have sent me a copy of. I am guessing that this has happened now because I recently found out that there is a 6 yr deadline for issuing small claims and this year would be 6 years since I signed the second agreement. Is that correct?

I am aware that there is a short time frame on this, but have acknowledged the letter as instructed but that I disputed the claim as wanted to check what it was in relation to. They did send two letters one to me and one to my husband. Does he have to register as well even though it is the same claim and the ref no on the letters is exactly the same?

I have already emailed the company asking for copies of any claims they say they achieved so that I could work out what has happened. They sent back 3 documents, 2 were letters from companies that had agreed I had been mis sold ppi and both had sent me the settlement direct and as a result I now realise that no fees etc had been deducted before I received it. However the dates on the letters have confused me as one settlement was made in Feb 15 which I assume is covered by the 2012 signed agreement which I cannot find a copy of, and the second made in August 2015 relates to the June 2015 agreement.

I do still have many of their letters dating back to 2015/2016 but unfortunately in a moment of mad decluttering I have somehow thrown out a lot of the recent ones although not sure how many are duplicates.

I am at a loss as to where to go from here. It is quite a large sum of money that I just do not have as am still paying of years old debts through a debt management company and a secure loan. I have asked about a payment plan as it appears they did offer me this option at one point.

I would therefore really appreciate any advice you could offer me as this is making me very anxious.

    Thank you for your time.
