    Hi All,

    I completed a CCA request to AIC who now own my debt and have had a reply direct from Barclaycard who originally owned the debt. they have sent a reconstituted CCA and varied terms and conditions, is there any way of checking these are correct and valid

    The purpose of a CCA request is to inform (remind) you af the terms and amounts of your agreement at the time you entered into it. If they have the original they should simply send you a copy of it. If thry do not have the original they may reconstitute one to give you what information they do hold, as accurately as they can.

    It sounds like they have fulfilled their obligation by sending a reconstituted agreement. Presumably, you are looking for an 'out' if they have lost/misfiled you agreement. Whether you can achieve this will depend on other factors such as the age of the debt, etc.

    If I remember correctly, with some reconstituted agreements the creditor can take legal action without the original agreement. With others they cannot.

    When did the agreement start?
