  • Small claims or county court?

    Dear all, I am having to take to court an acquaintance who owes me £11K in total. The original sum is £10K and £1K is a yearly interest.
    I have no previous experience with legal system, and people tell me that Small Claims Court is more official. Can i legally make two claims in the small claims court - for £10K and for £1K? Also, I am reading that the Small Claims court deals with up to £10K - does it include court fee that I’d like to claim back and interest?

    I believe that as your total claim is over the£10K then,even without the court fees, it will not be small claims track

      Thank you for your response! I know that. Hence the question - can i split thr debt and make two small county court applications- one for 9999 and another for 1000+?
      from what i read two SCC applications are faster processed than a CC one....

        The court will frown on two claims for the same reason

        small claims is county court. It is just a track within the county court system

          You don't get to choose which track a case takes, the court does but as a guide anything below £10000 is usually considered to be a small claim. How are you working out the interest of £1000 on a £10000 debt? How old is the debt? You will have to sue for the full amount two related applications will not be allowed and each would put the other in jeopardy.

            Thank you! It helps. So i will fill MCOL form, and hope its straight forward enough.
            The 10% interest was agreed & contracted. The debt is 2 years old, he paid interest in the first year, then. Disappeared when it came the time to pay in this year and return the whole amount.
