    Thank you for accepting me.
    Question on a problem with statute barred debts.

    My partner has been issued a CCJ, the debt is on unpaid Water bills from 2012. He was giving cash to his roommate to pay the collective bills at the time, but she didn't and because he was listed as the lead tenant, the debt collectors started chasing only him.

    As usual, the debt was sold between companies, previously was to Cabot, and most recently Lowell, but in all this time he never admits debt, refused to pay it and ignores it.
    He thought that is already too late for the debt-collectors to do anything after 8 years, until recently he checked his credit file and found that he acquired a CCJ from 2020 and we aren't sure how to proceed.

    I've discovered through this forum (many thanks!) that this is called statute barred debt - but what do we do next? Do I contact Lowell Financial and request something? Do I appeal somewhere in court? Do I provide the letters from 7-8 years ago that he kept proving this is a statute barred debt, if yes who do I provide this information to?

    Set Aside Application cost £255 fee but if certain benefits free, fill it out and state evidence is essential send DSAR as he must of been on original billsSubject Access Request Letter get proof posting they have 30 days to respond. jaguar

        OK - so to confirm. We fill in the Set Aside Application, pay the fee, send together with attached the DSAR (via Subject Access Request Letter) to County Court?

        DSAR I should request from the claimant, correct?

        Is there a formal letter example of what and how to write to the claimant or just simple request- "write to the claimant and seek their consent to set aside"?
