    I'm new to the forums

    Sorry for the repeat post, but this whole thing is triggering my husbands Anxiety issues and I'd really like some help.

    I've signed up because I received the letter (attached below) in the post.

    I don't know what I should do about this, as this is the first time I've had a letter from Lowells and I did not receive the court documents that should have been sent.

    The news about the CCJ is not a surprise as I had been told about this when I applied for a job that required a credit check back in 2018. It was the first I knew about this but as I planned to return to college I felt that trying to get it set aside was not worth the fee and as I said this letter was the first letter I've had from Lowells. The date on the CCJ is 28 July 2015.

    I was also under the impression that another agency was collecting on this debt and I had made an agreement with them which has since been settled as of 2017.

    Any advice or guidance would be very welcome.

        How much was the actual CCJ as ordered by the Court? They say the debt has already increased by £134-16 is this their costs or are these costs included on the CCJ?

        An application for a Warrant of Control will add £110 to the debt, plus there could be extra costs for a Bailiff to attend. Even if it got to this stage the Bailiff has no automatic right of entry to your property .

        If you are intending to pay by instalment it is much better to have a Court validate the rate at which you pay. If you do it through Lowells they will try to persuade you to increase your offer every 6 months or so whereas if your circumstances don't change then it is very doubtful a Court would allow an application to increase any agreed payment. Cost of an application to do this is approx £50 or if on certain Benenfits or low wage then it would be free. In the meantime just enter into correspondence with them by post to delay their intentions.

          Thanks for your response.

          Thing is I'm not entirely sure that they were in the right to acquire the ccj as I believe that this was for the same debt that I was also being asked to pay another agency. I am a bit confused about that point and I'm pretty sure that it's the same debt that I cleared with that agency.

          If I don't have to pay I would prefer not to, especially since I'm not even sure that I should be paying for it.

            Well in that case you need to start asking questions both of Lowells and the previous one. Subject Access Request to both. You also need to know who it was that obtained the original CCJ and have either of these companies applied to Court to become the Claimant.
