  • Santander - DWF - Fiasco - Trying to clean Credit File.

    Current status. CCJ - Charging Order - Constant chasing for different amounts.

    I'm looking for some help and guidance if I can for a debt that is quite old now and I would like to resolve but struggling to do so.

    Agreement with Santander Consumer Finance: £24,985 4% per annum 37 months for a brand new car. Agreement Date 15th Jan 2014

    Shortly after taking out the agreement, I lost my job. I hurried my head a little bit and the car payments fell behind, it resulted in the vehicle being repossessed. So I lost a considerable deposit and my car.

    It went to court and and a CCJ was granted for £10,059 on the 7th May 2015 (Firstly I believe this will fall off my credit file on the 7th May this year regardless??? )
    They then went ahead and gained a charging order on my property.


    I have made payments and sporadically to DWF for sometime, however my position has changed and I am trying to get my credit file back to a decent score and this along with one other CCJ and 2 defaults are hampering this. So I have made offers and resolved my debt apart from this one. I have sent may letters and made many phone calls to DWF to try and get a full and final settlement amount. They just don't get back to me. Or send a generic letter saying they need an I&E form filling in. I haven't done this yet.

    I made an offer to them, which they said they put to Santander and it was rejected. I have since phone Santander and they knew nothing of the offer. Do they legally have to give the client an offer?

    I then without warning got woke up to a loud knock at the door from a gentlemen from the court telling me I need to attend to court about this debt, the amount on the paperwork said the debt was £5400 + £55 costs.

    I called DWF upset and said I have been trying to sort this and the court visit was quite distressing, I said if I just paid the £5455 would this be the end of the matter, she agreed and said she would stop the court action as she could see I have been trying to contact them. I then (maybe stupidly) said are you sure this is the correct amount, as I still receive letters from Santander with a different amount, I know what I've paid from the original £10k and I thought it was more likely to be around £7500. I wanted to be sure it was the end of the matter.

    Anyway, subsequently DWF have now told me they got the amount wrong and it should be £8822.07 - Santander have sent a letter saying it's £8797.07

    after calling Santander (didn't want to deal with DWF anymore) they said they can't deal with me direct now. I have to deal with DWF, I explained about the amount on the court papers and Santander rang DWF while I was on the phone - they said to Santander they got it wrong the amount is £8822.07 as this includes costs. (Not way are the costs over £3000 as the court letter says costs were £55 and they haven't actually produced anything yet.

    So sorry for my long explanation - but I am looking for some guidance, is it worth trying to fight this, should I fill in the I&E - what sort of offer should I make, should I apply to the court for it to be set-a-side. Anything else I should do or advise I can read about what I should do.

    Bottom line, I know I owe them something - in my head around £7500 - although never taken any advice on what I should do and never offered any help.

      as a start ask (in writing) for a breakdown of the amount they are claiming
