  • Can I put a charge on my ex partners home ?

    I used to live in SW London with my partner & 2 children. We were running 2 businesses. They were both in her name. I signed a new lease agreement for the business I was running after 3 years of negotiations with the Landlord. I signed the lease on the 3rd April 2019. On the 4th April 2019 she crossed my name out on the lease, provoked an argument, threw herself down the stairs & called 999. I was horrified, police arrived & i was arrested. Now i find out she had been committing benefits fraud. She lives in our SW London home with our 2 children she has alienated from me. I now find out through freedom of information that she has paid No tax or National insurance & that she fraudulently signed my name for 6 years committing about £200,000 of fraud & tax evasion. She also has a 4 bed rental property in Birmingham. Can I put a Charge or something on this property in case she tires to sell it as I believe she could have paid her mortgage off with the fraudulently claimed benefits.
    I want to protect my assets in my SW London home ! ... any advice please ? .. I’ve reported her to HMRC & DWP & even gone through my MP to make sure they are aware & investigating!

    Only if you can prove that she owes you money, and you are able to prove the debt, that is an important fact, no money forthcoming, so you make the next step by taking her to County Court, If she makes no effort to pay I believe then you can instigate a charge on the property.

      is this the same case as the poster who wishes to appeal the conviction which appears in another thread?
