    hello, I am a newbie here I am hoping for some advice please,
    I have a debt that I have been told in writing that it is unenforceable after my request for CCA
    I am not paying anything - after some time, and not replying to the debt company's letters etc., I did receive a court claim
    I then made a defence online on the money claims website, it registered my defence for which i stated that I had letters showing unenforceable.
    I now have received a small claims track N180 form to complete, I have no idea what to do, the front letter states that this is now a defended claim and that it appears that this case is suitable for allocation to the small claims track
    can anyone help me please, I am very nervous about this

    So with what part of the form are you having difficulties?

    Who stated the claim was unenforceable, and for what reason?

      Thank you, the original debt is a credit card debt and was taken over by a collection company. When I requested credit agreement documents they replied with a letter stating they had deemed the debt was unenforceable and stated they would not be able to enforce action against me.
      I put this information as my defence on money claim online.
      now i have received the directions questionnaire and i am not sure what to do going forward

        As you are defending the claim you must return the N180 form, otherwise the claimant will obtain judgment without a hearing.

        Have they ever produced the CCA?

            no, they have just sent copy statements, the original card was applied for in 1995. So would I be right to say that I complete the form with my statement that i do not agree the claims track and way that I have letters stating the debt is unenforceable ?

              The small claims track is the correct track, unless the claim is over £10,000

              No "statements" with this form. That sort of statement should have been in your defence

                  No you can object and say what track you think it should be on.

                  What does having made a defence got to do with track?
