    Good morning

    Looking for a bit of sensible advice, I received some postal parking notices this time last year. We were attending the gym and had parked after 5pm in a more than half empty car park, I have to confess we did see the sign about no parking between certain hours but as the car park was pretty empty we assumed we would be fine, we parked here 7 times before the first parking notice came through, then it was pretty much one every day until they covered the 7 visits, my partner said just to ignore them as they aren't enforceable, however over the year I have received a couple more letters from them with notification the fines had been passed to CST Law to collect, I received a letter from CST on Saturday stating that they have been instructed by smart Parking Ltd to commence legal action against me to recover the amount outstanding as I have failed to pay anything towards the fines and failed to provide a valid reason of non payment. Should I be contacting them to make some kind of payment plan or ride it out as my partner wants to do, the car is registered in my name but I wasn't actually the driver my partner was but I don't mind saying I am very uncomfortable about not doing anything.

    Silly to ignore, as you have found out. Do you still have a copy of the PCNs you received? If you were attending the gym why can't the gym cancel? Is this a "enter your VRM at the desk" place?

    If you still have a PCN then post it up suitably redacted but leave dates.

    CPR 31.14 request to the solicitors requesting copies of all the PCNs, readable photographs of the signs that allegedly created the alleged contract taken at the relevant time, a copy of the contract that gives their client the authority to operate in the car park, issue charges and take legal action.

    SAR to Smart request copies of all the information they have about you and your car, VRM xxxx

    It is not a fine, it is an invoice for an alleged breach of contract. Perhaps you can get some photos of the signs and post them here.

    There is still time to name the driver but unless the driver lives abroad then not a lot of point.
