  • Neighbours Planning application will be a nightmare

    I bought my house 16 years ago. I have a flat roof on the side of my house which is attached to my neighbours garage wall. I bought the house and it was already constructed and had been for some 10 years prior, so in total 26 years.
    My neighbour has now submitted planning permission to demolish the wall to build a single story extension. My boiler, toilet and freezer ,dishwasher are in this side entry. Have i any rights or can he demolish it and leave me to pay out money to reconstruct. I don't have any money for a start as it was a retirement project for 2 years time.

    Unless that wall was originally a free standing wall dividing the properties, and the garage added to it, I assume that the garage is built entirely on his property.
    This would mean the wall is not a party wall, and your attachment to it is a trespass.

    If that is the case you have no rights, and he can require you remove it.
    However if he removes it he should do so without damaging it.

    I would suggest a conversation with a view to you being able to construct a support alongside the existing wall before he demolishes it.
    A series of wooden posts and a supporting beam shouldn't cost too much
