CCJ with Arrow Global not fair

  • CCJ with Arrow Global not fair

    Hi there!

    I recently discovered that there is a CCJ of £1,340 on my credit report. The CCJ was registered by County Court Business Center and was applied by the Arrow Global but originally came fro Lloyds TSB bank.

    Let me explain so everyone understand.

    I had a credit cards worth £200 back in 2007, I spent £100 only. Then I asked a Bank that I didn't need this anymore so I paid it off in 2008. From this day I moved several times because of my job. So recently when I tried to get a mortgage, the lender informed me I have CCJ registered on my File by Arrow Global. When asked Arrow, the told me they bought this debt back in 2013, and that I should ring Lloyds Bank for more information. When spoke to the bank, the only information they have is that that account was closed in 2011, they sold the debt on 2013. I asked them to pull the account record which will confirm I have paid, they said to me they don't have those records and that I should go back to speak to Arrow Global. They also told me they will write Arrow to give me those info.

    However, AG have no any evidence that they send me any letter, including Claim form. When I spoke to them, a lady said a claim form was sent to me on 9/May/2017 and the Date of the Judgement is 1/Jun/2017. What they said to me is that I have to pay it and fail to explain why they charge me with £1,340!

    Also, I did not receive any Notice of Assignment or and Claim form. Both, Bank and Arrow fail to show me any proof of information I require.

    Please help me here as I am looking to get a mortgage.

    Yes apply to the court to get the judgment overturned because the claim forms were never delivered. The claim will then be live again and you either pay it or defend.

    Others will help with the detail/

          Also, anyone correct me if I'm wrong. The Limitation Act, 1980, places a time limit of six years on many outstanding unsecured debts. In England, Wales and Northern Ireland, the debt remains in existence but a creditor is unable to initiate court proceedings to recover it. So, my debt was back in 2007 and the Judgment was on 2017, that's is 10 years. So even if that was the case, can I ask a court to set this CCJ aside? Any advice please. I just want to know my options here, though I owe nothing to the Bank.

            But if you were not there to shout "statute barred" then the claim goes through.

            So the claim reopens and you now shout "statute barred". But it depends on when the debt was defaulted.

            And claim the £255 back from Arrow.

            Or pay £100 and get a setaside by consent but they will require payment of the money allegedly owed.

              Thank you for your advice. Also, if anyone knows, how many days do a person have to respond to the CLAIM FORM before it goes for Judgement?

                14 days to repond from date of service. If acknowledged the 28 days
