  • Ccj judgement set aside-refused! What are my next options help??!!

    Hi,

I has a telephone court hearing today to get a CCJ set aside. It was entered against me 12/09/2019. I was genuinely unaware until I checked my credit file. I thought the grounds on which I was appealing would have been enough for the judge to rule in my favour.

The original debt came from E.on energy. Upon contacting them to find out further information as to why I had never received any letters from them, they said the meter for the property I was living in at the time was 'faulty'. It was showing as 'free vend mode', which means it was supplying 'free' electricity. Baring in mind this was a pre payment meter. I was 19 at the time and was obviously not very wise, and assumed the landlord had passed on my DD details, hence why my electricity has never switched off.

I left the property 10 months later. E.on sent a statement after 1 year, to which the then current tenant notified them I no longed resided at that property, and they returned all letters addressed to me. E.on has stated all of this and will be sending proof, that they have no sent no more letters addressed to me as they didn't have a forwarding address.

The only letter I received regarding this debt, was when it was passed over to the debt company 5 and a half years later.

I have contacted a solicitor, as this is going to have a massive impact for me, but the fees are very high. I was hoping I could appeal this. any advice would be received gratefully!!!
