  • Employer checks for right to work in UK post brexit

    Hi there just a quick question, my place of work has recently sent a mail shot out advising that we have until Friday this week to provide evidence to show that post Brexit i have a right to work in the UK. They have asked(demanded) that we upload a passport shot or other documentation to prove our right to work in the UK. Myself and a lot of others like me, have been working for the company for 15+ years, we are all 100% born in the UK with full rights to live and work here. Do we have to comply ? I am reluctant to give them any more personal info than they need and do not feel comfortable in them holding on to passport or similar information with a risk of it not being secure being beyond my control. Is this necessary for employees who have been working for a company for so many years ? What has changed ? Cant find any reliable sources to refer to online. Many thanks.

      The change has been BREXIT. Don't you just love it!

      The company are just covering themselves so copy you passport and send it to them.

      Or send alternatives listed in the document referenced by EFPOM, such as birth certificate and NI number

        Hi thanks for the reply, the company was the recent victim of a cyber attack and information from the business was compromised, including HR/personal information, to what level we don't know, which is why most people are overly worried about now providing this information to them. If the info has to be provided, how can we be sure where its being stored, what they're using it for, how long they will keep it for ? Will a flash of the info on a teams meeting for example be sufficient for them to tick a box or do they need to have it stored on servers somewhere for these Brexit purposes ? Cheers

          I appreciate your concerns particularly if they have been a recent victim of a cyber attack.

          The company is requried to make a clear copy of each document in a format which cannot be altered and retain the copy securely which can be electronically or in hardcopy. They are required to keep this for the duration of your employment with the company and for a 2 year period afterwards.

            Hi, i have gone onto the gov.uk website, as if an employer checking on an employee, in the absence of a passport it asks a series of questions , have you been TUPED, how long have you worked there ? It then tells me that if i have been in continuous employment with the company since 2008 then a right to work check does not need to be carried out as the necessary checks will have been completed at the point employment started ? So is it a legal requirement that i ALSO NOW need to provide my passport or not ? that seems to be the angle.... ?
