Just wanted some advice on how this may roll out in court.
I was married, separated when son was 2 years old. Visitation was first arranged as Wednesday overnight and one night at the weekend fortnightly. He also looks after our son from 3pm until 6/7pm on a Monday, Tuesday and Thursday as I am in work and he finishes work at 2pm.
Overnight visitation was stopped after I had trouble with his mother who he was living with, as she was becoming abusive towards me when I went to the house. I made aware via solicitors letter that overnights would be reinstated when he found an alternative address.
He has now been living with his new partner since July 2020, and has only reinstated his Wednesday night and refuses to take him at the weekend, even for a few hours during the day. He has said he "does enough" for his son with the Wednesday overnight and looking after him until I am home from work.
This means I work 45 hours per week Monday to Friday, with also no free time at the weekend. I don't have a partner and live alone.
I have tried to reason with him that I need time as well, but have fallen on deaf ears. I don't understand how the arrangement worked previously yet does not now. The only difference is, he has a partner.
I am simply exhausted, I have no life at all as I go to work then have my son the rest of the time as nobody else can look after him as he has additional needs (assessing for autism etc)
Does the court take previous arrangements into account or will they just see her already takes him one night per week and leave it at that? I don't want to waste a lot of money to have the same situation
