Hi all,
I'm looking for some advice regarding a CCJ that I have discovered on my credit file. I have read many other threads, however, it's difficult to relate to mind when their circumstances are different.
Background:
Myself and my partner are trying to buy our first house and after checking our credit files, I have discovered a CCJ that was registered against me in April 2019 for an old loan. I can't deny, the loan belonged to me and there was an outstanding balance of £303.00.
Basically, once I graduated from University and I was living away from home in Portsmouth and I got into debt. I was taking out a number of payday loans to get by and pay the previous loan off etc. I had my graduate job and I was working in the NHS, I just had so many outgoings at the start that I could not keep up with. I eventually took out a larger loan to and paid off all the small payday loans, I have now finished paying the larger loan which was paid off around a year or so early thanks to all the overtime hours I was doing at work. Since then my salary has steadily increased as I have become more senior in my role and my outgoings have reduced since paying off old debts and I am in a much better position financially. I completely forgot about the loan for £303 with MoneyBoat.co.uk, hence why I did not pay it off with the larger loan I had used to pay all the others off. I'm more so gutted because I had paid everything else, including the larger loan, without defaulting or missing the payments, I simply just forgot about the one other loan which has resulted in the CCJ.
At the time I discovered the CCJ I had already moved to Bristol for work but I didn't update MoneyBoat.co.uk about my change of address because as I mentioned, I forgot that the debt existed. If I had received the notice I would have called immediately and paid it off.
I have read some threads that suggest making an application to get the judgement set aside with the defence that I did not see the judgement, and that if I had seen it I would have responded and settled the load immediately. I have contacted the claimant and they have informed me that they will not object if I make an application to set aside either, meaning I will not be liable for their fees, so they said.
I appreciate it's far fetched, but does anyone know If there is ANYTHING I can do to support my application for a set-aside? It's daunting to think that it is going to remain on my file for another four years, preventing me from securing a mortgage.
