    Today I have been told by my solicitor if I dont accept MIB compensation offer I will have to lodge a substantial amount of money by close of business to cover the arbitration costs if I loose..The reason I do not wish to accept the offer is that the medical Dr report states that even if I had not had the accident I would of had the condition with in 18 months But there was no explanation as to why.Plus I had no pre accident problem in the region concerned .Any help much appreciated I have to have my final decision in by the morning .This has taken over 6 years to get to settlement stage Thanks in advance

    Sorry, but with that little information it is impossible to comment on what course you should take.
    Has your solicitor not advised you? presumably he has access to your medical records

      They said it was a fair offer and I should accept.But this has already been 6.5 years and I had no symptoms prior to accident .I was hit by a horse box whilst on my bike.After mri diagnosed with oestietis pubis and mis alignment of symphis pubis .limited mobility now and still awaiting operation in future. Yet told I would of had this condition anyway just brought firward by accident Its the one sticking point .Other injuries lacerated hand and damage to shoulder.

        If you were unhappy with this diagnosis did you arrange for a second opinion from an expert in that field?

        If you don't accept the offer, and the arbitrator finds against you, you could face substantial costs

        To make sensible comment one would need to see the reports, and have them evaluated.

          The mib sent me back to the same specialist after 3 years .he agreed i still had limited mobility severe pain etc But has given no explanation as to why how he has come to the conclusion thst i would of had this anyway.When i said to my solicitor i wished for a second opinion they flipped.I cannot understand why they have done this 2 days befire Christmas and say I am not sllowed extension till its answered.Thank you for trying to help .

              Hi 25 th Nov At which time I contacted the solicitor and listed my concerns.They said would take advice from my barrister which came through this afternoon.Believe it is the 29th but solicitor insisted latest tomorrow morning because of holidays I asked could i contact mib myself and ask for extension .No

                I think you should follow your solicitor and barrister.
                It is rather late in the day to start challenging the award without running the risk of substantial costs.

                Obviously I say that without any real knowledge of the issues

                In general MIB compensation is in line with Judicial College Guidelines
