    Hello,

    We have moved state and looking for new home. We located a building in a 55+ community, the main house construction was finished and drywall complete internally. TO finish the house, the trim has to be completed, kitchen installed, laminate floor and carpet laid down, plus some additional electrical work and deck modification we agreed to.

    We signed an agreement in the first week of Oct and paid approx. $20,000 deposit with closing estimated as being Nov 30th. As we agreed to purchase our own appliances we were advised to order them as soon as possible and they were delivered to the house on Nov 9th for them to install. We also chose the carpet we wanted.

    Since then the builder has done very little to the house, we keep calling for updates and get lied to, "oh, the trim is being done next week" (Nov 9th) it wasn't and still hasn't been started. We get put it touch with a new manager who promises an update every Monday and does not do anything. Certain people never ever reply to e-mails. We have spoken with the Project Manager on the phone a few times and generally get the run around every time, blaming it on "can't get the parts", "contractors are sick". We were asked to meet the project manager at the house to choose kitchen accessories, he was 30 mins late, on the phone to other people all the time, didn't know what accessories came with the house or were upgrades. We then found out that they hadn't ordered the carpet and had to choose another style because it was out of stock.

    We are a cash buyer, no mortgage involved, don't have a property to sell so I would have thought the builder would have been keen to finish the house and get the money.

    While we understand that COVID is impacting a lot of businesses the lack of communication is very frustrating and its almost as if the builder isn't bothered whether they sell the house or not.

    We have started looking elsewhere, we have signed no other documents since the missed closing date of Nov 30th.

    I would like to know what our position is regarding walking away from this deal and would we be entitled to getting our deposit returned due to the builder missing the closing date and being disinterested in completing the house.
