    Hi everyone,
    Please am in urgent need of help, am a vulnerable person with zero income just managing with my partner, I've been off work for several years now due to my health condition.
    I received a ccj on November, iresponded on time with form N245 and my budget.

    Just received the responds from the court which states that upon considering the defendant application to stay the writ and pay by instalments

    1) The writ of control dated ... be stayed.
    2)The matter be transferred to the defendant home court.

    *Please what can I do at this point?
    *Do I need to submit another forms? If yes do I need to pay again? And is there a time limit?
    *Can I write to the court that am vulnerable with my doctors report?
    *How can I make them return the dept to the original owner?
    *Bailiffs has visited once and promised to return how can I stop them because it's affecting my health alots.

    please help!!!

    At present you do not need to do anything.Your application was partially successful in that the Stay of Execution has been granted albeit on an interim basis pending a further Hearing - for now the Bailiff is not permitted to visit you.At the present time there are no further forms submit meaning there is nothing further to pay.

    What will happen now is that the case has been transferred to a Court near to where you live and you will get instruction to provide a defence to your application for a permanent Stay and your other application to pay via instalments will also be considered. It could be that the Claimant will accept this payment plan and as long as it is kept up then you will receive no Bailiff visit - however should you fail to keep it up even by just 1 day then the Stay is automatically lifted and Enforcement will continue. It is at this time you also submit your vulnerability claim.

    Did you pay to submit your application or did you apply for fee remission?

    You haven't mentioned anything about the original debt & CCJ - is that something you care to discuss as there may be other points we can help with.

      Thanks Ploddertom this has been so helpful.
      The ccj was in regards to a cost award from employment tribunal that I was litigants in person.

      I've just received a letter for a telephone hearing which is set for next year but they've no ask me to write any defence/witnesses statements in regards to my application, am so worried with lots of anxiety as am not sure what to expect, please c
      .
      Please am not sure if i will be able to cope with the hearing on my own, is there anywhere I can get free help for a little support during the telephone hearing?

      Is there anything I can sent to the court that will be of help during the hearing since there is no request for defence or witnesses statements?

      Am so confused

        It could be they have all the information they need, if they need more they will ask. As far as I know there is nothing you can do to get free help for support apart from finding someone who may be able to go with you but they would probably not be able to speak on your behalf. You could write to the Court to advise of your anxiety issues. There are others on her who know more about this than I do.
