  • Advice please on F&F

    Hi
I have recently been diagnosed with Pulmonary Hypertension, which is a life limiting illness. I have 4 extremely old debts (total £11,042) which have been confirmed as enforceable. Family members have offered some funds to help with my situation. I can offer approx 40% to Robway x 3 and Moorcroft.....do you think this is acceptable and should I include medical records? Many Thanks

Bearing in mind that if they have been sold to debt recovery companies then they will have paid much less than face value. Get the family to write with a offer of about 25%of face. Get them to pay on the understanding that this clears the debt and it will be marked as settled and no further reports will be made nor will any any attempt to sell the debt on.
The family ned to send building society cheques for the payment. This creates a new contract and extinguishes the old debt.

I can only tell you what I would do... These debt are unenforceable for a reason (lost agreement, statute barred, etc.). Personally, I would not pay them a penny but we all have different moral compasses so you must decide for yourself. Think of your health and your family and not the (often underhand) debt collectors.

How have they been confirmed as enforceable? How old is extremely old?
