  • Subject Access Request 3rd Party

    My GP surgery sent a report to the DVLA. They still have the letter in their system but said I cannot have a copy of it as it has 3rd party data in it.
    "A Subject Access Request does not include data belonging to a third party therefore we are unable to send you any reports completed for a third party."
    I asked if they could redact that but they refused. It is only the DVLA medical department address and maybe the persons name (which I already know) so I do not understand why not.
    Is there anything I can do to get the report?

        the GP surgery should redact any third party personal information and disclose the document. The fact that it has some third party data in there does not automatically mean that they can refuse to disclose it. See link below and read step one in particular.

          Thanks Rob for the reply and link. I have made a SAR to the DVLA and have just emailed the GP surgery the link too.
          Hopefully they will send it to me now and I can cancel the SAR with the DVLA.

          No sure why they refused. The DVLA asked me if they could go to my GP. So I already know the 3rd party information inlcuding the indivuduals name who made the request.
