  • 6 months break clause.

    I have 6 months fixed term Short hold tenancy agreement which also has a 6 months break clause. The tenancy started on August 8th 2020. On December 7th 2020 I decided to give 2 calendar months notice and intend on leaving on February 8th as required by the contract. The contract states "Either party may bring to an end the fixed term of this tenancy by serving not less than two calendar months notice in writing, provided that such notice may not expire earlier than 8th January 2021". The landlord has come back to me and stated that I cannot give notice because I have not lived at the property for six months yet so the earliest I can leave is April 8th because the earliest I can give notice is on February 8th. Is this correct? He has stated the solicitor that drew up the contract has said he is right.
