  • All neighbours pipes on my land!!

    Hi, Just wondering if someone could help me please.

    My neighbour built her extension afew years ago and built right up to her boundary line. On the planning application it shows that she shouldve left space on the side of her extension and she hasnt. She was also supposed to have all her pipes on the rear of her extension but she put them all on the side. She has her kitchen and bathroom pipes, her guttering and her boiler pipes all on the side of her extension which is where the boundary is. I have spoken to her on three occasions and the first time she came and had a look and she agreed and said she would look into moving them and would get back to me soon. I also made her aware that if her pipes needed mending I would not allow her access to fix them and it for her benefit if she removes them. It had been a month and I had not heard anything so I knocked on her door to ask her and she is now saying I am not going to move them as they have been signed off by building regs and that is what her solicitor has told her. I have spoken to building regs who have told me they would not tell anyone such a thing. I have spoken to a solicitor who has told me that she can only keep them there if it has been over 12 years which it hasnt and that legally she cant keep them there as it is not her land and that she is trespassing. I know need advice on what to do going forward. Whats the best legal way to go to get these removed?

    P.S i couldnt do anything before due to long lasting health issues.

    Gutters, down pipes etc in your airspace with no right to be there, are a trespass.
    Write (first class post with free certificate of posting) insisting on their removal.
    If that does not prompt action, as a last resort, you could apply for a court injunction for an order for their removal,

    However mediation is a better way of sorting the problem

    PS probably you could not prevent her access to maintain/repair her pipework etc cf Access to Neighbouring Land Act 1992

      Thanks for your responce!!

      I will try speaking to her again and yes i agree that mediation is a good way forward bit unfortunately with some people this can be very difficult!!
