Hi some direction needed please. I have been named sole exectutor of a will and having been through some paperwork found correspondence from a debt collection agency from a credit card company passed on to them a (so called) historic debt from 2 years ago.
The latest letter from the debt collection agency stated to the deceased that they acknowledged his query and would investigate.. no further correspondence after that for a year.
I called the debt collection agency and they advised that the deceased did indeed contact them asking for a statement of account because he didn't agree with the debt for some reason (I don't have the specifics). They advised they requested this from the credit card company but they didn't send it over so the debt collection agency passed the debt back to the credit card company.
I have registered the death with the gazette and am just waiting to see whether the credit card company come forward with a claim on the estate. If they do, how enforceable is their claim on the estate seen as there was a query prior to death by the deceased prior to their passing? If they took it to court, I would not know the defense in detail just as the deceased would to counter their claim but I do know that their claim would not usually stand up in court if they applied for judgement while he was still alive and had a query on it which they did not supply the details on he requested some time ago.
