  • Car insurance consent and indemnity form

    Help ? I was asked by someone to give another person a lift . Unknown to me this person was being peruses by the police . I felt set up as the person who was getting the lift in full view of the police snatched my keys an jumped in the car with another party . I foolishly jumped in the car to try and stop him . This resulted in him driving off and a police chase . It was a terrifying experience and ended up with the police putting out stingers to stop this didn’t work so the police hit the car and It rolled resulting in all three of us being taken to hospital . I gave a statement to police saying what happened ie he stole my keys and they told me not to worry they had it all on camera and they know he did . I also told them this at scene of accident. They gave me a crime number to give to my insurance . Two days later cid came to see me for a new statement as said police shouldn’t have interviewed everyone after a big accident and while on morphine . Gave a fresh one they were happy as my side of events exactly the same and that is how they saw it too . Assured me they had so much evidence against the thief and not to worry . Gave me a new crime number to give to insurance . I was told just unlucky to get caught up in this . Fast forward ... insurance accused police officer of being difficult and not giving them information . Police told me insurance know full well that if a criminal court case coming up they can’t and would have to apply for crime report and trying not to pay for it . Then I had to fill in a form for insurance consent to getting this report statements etc. I did this willingly as had nothing to hide .The end result is my insurance has cancelled saying I didn’t report theft to police. I don’t understand I was with police all along and told three different officers . Was I meant phone from my hospital bed separately and report car stolen .My car is somewhere written off down in England 100s of miles away and they have asked me to sign a consent and indemnity form so that I am liable for all costs . Also a third party claiming who I have no idea who this can be unless the thief or other person . I am absolutely devastated at this turn of events as I have no way of paying and this is making me so ill . I don’t know where to turn for help and at a very low point . Police can’t get involved as they just deal with the criminal but told me to Persue insurance they are at it . The company dealing with insurance said blame police for this state of affairs as car not reported stolen . ( this is the clause they say why they won’t pay out)I have to go to court and be a witness to my car being stolen so don’t get this .Even guy from insurance said ye it’s a funny one you being a witness to car theft but no report of stolen car . Should I have phoned from the hospital separately to report car stolen even though police witnessed it ? And we’re with me taking a statement . Please any advice where to turn or what to do next would be really appreciated .

    I would also like to add that the person who asked me to give their acquaintance and them the lift who also got in the car refused to give a police statement .

      This is going to take time to sort but please name the insurers and if it is online a link to the policy wording.
      Also is this being handled by your insurers or a claims management company appointed by your insurers

        Hi DESB the insurance company is first central . The consent and indemnity form is from skylar insurance . The reason they said not paying out is the plolicy states that you have to report the the theft or attempted theft of your vehicle and have a crime number . They said that the police have confirmed no report .This after them reading crime report . Yet police gave me a crime number for insurance after my statement . They then gave me a new one a couple of days later due to how the first police handled the situation in hospital but happy it was still the same . They told me to give new number to insurance . I

            Police officer said they can’t give insurance all the facts and insurance should know this as could interfere with court case of criminal . In the consent form I also signed where it asked if I wanted a copy of police reply . I did sign but haven’t received it .

              Can I write to insurance saying I need longer before signing the consent and indemnity form so that I can seek advice etc ? Ps I have only two days left to sign as only gives seven days . Sorry for all the questions etc but really stressed out

                I'm afraid the situation is far from clear.

                Please give a link to the actual policy wording.
                What insurance cover did you have? The bits of paper you have posted suggest you only had Road Traffic Act insurance.

                Has anyone made a claim against you?
                Central appear to be saying there is a county court judgement already
                Skyfire are part of the same group as Central and appear to want to take over your defence (but with the right to recover the costs from you!).
                However the claims they wish to defend you against are those which you are insured against under RTA cover provided by Central.

                On the information you have provided I would advise against even communicating with Skyfire at the moment.

                  Thanks so much thanks for that I will try and look into policy tonight . . I am not aware of any ccj judgement or claim only the one saying since this incident there’s a third party . Really appreciate your input

                    There is a charge (£10?)

                      Ok thanks for that but 100 % I haven’t . I tried to look at my policy but can’t get into portal as saying account doesn’t exist . Wander if this is because it’s been cancelled . I have requested a copy .

                        Hi DES8 paid the £10 to above site and no ccj or anything came up my file clean as I thought but glad to do it for peace of mind .

                          Even more confused today . I sent insurance an email asking for police response . They asked if I wanted this on first consent forms . I did but they haven’t given them to me . They have ignored my email requesting them . They have also ignored my email saying I need to seek legal advice before signing consent and indemnity form and requesting a copy of my policy . Phoned this afternoon and got a really horrible man who tried to bully me into signing it and he brushed me off when I asked before finally saying yes we have them . The even more confusing thing is after his colleagues telling me there’s a third party the other day the one today said there isn’t but one might turn up in next six months . Its all so confusing and I can’t afford a lawyer . Where do I turn ? Any advice really appreciated

                            So it seems there is no third party claim (and difficult to see how there could be one) so no need to sign any forms.
                            If your insurance was RTA cover onl, Central as insurers deal with any claim involving bodily injury.. No need to sign any thing for Skyfire
                            If there is a claim against you for damage to property you can defend it yourself, or appoint your own defence team. Nothing to do with Central or Skyfire.

                            As they are not responding to your polite requests for information send them a Subject Access Request.

                            Insert into it that you require a copy of your policy, including schedule
