  • Council tax wrongly issued court summons

    Hi,

    Received a court summons for non payment of council tax.

    Background:
    - I pay by SO monthly over 12 months at £153.
    - I received a letter on 3/10/20 than my account was in arrears (council expect £183 over 10 months where as I'm paying £153 over 12 months), nevertheless I overpaid by £153 hat month.
    - They sent a court summons on 18th Nov with added court fees (no other letters in between)
    - On the day I received the letter, I paid the remaining balance in full for the entire year
    - I did not pay the court fees as in my opinion the council have no valid claim for these.

    1) Can the council still seek to recover the Summons Costs (£86)
    2) If they do, can I counter claim for the time I've spent sorting this?
