  • Contractor damage to unadopted road

    I live on a property on an unadopted riad so along with others have responsibility to maintain the road. Contractors are currently building two houses which have to be accessed using this road. Should we have been notified of the pending use of heavy plant machinery with the potential to damage the road ?The road is now covered in mud can we demand the contractors clean it? Cement lorries have damaged lighting and left cement in the road and the road is often blocked by deliveries do we have any power to stop it?

    Our road is unadorned and we have to maintain it. On our deeds we own half of the road fronting our house. If you are in the same position I believe you would have grounds. Is it a right of way ? If not should have required permission to access site. I trust you are working collectively. Have you involved your local councillor or M.P ?
