  • Holidaying in EU after brexit.

    Basically am a uk citizen married to an Italian citizen - we live in Uk. Retired 3 years ago and have enjoyed spending very long summers and other times of the year in our holiday home in Italy. From January 1st, uk citizens are only allowed 90days in any 180days in EU. This is obviously not good for me! Is there any sort of visa/excemption available. Many thanks

    And we have been (mis)informed that transition to non eu member will be easy and hardly noticeable !!

    Suggest you go with your wife to the Italian embassy and see what they say. You must know by now how "flexible" the rules are in Italy

      You may wish to reconsider your view that you are being "hard done by", following the UK's withdrawal from the EU.

      It has always been the case that EU citizens are entitled to reside in the host EU State for a maximum of 3 months without any formalities. Art 6 Directive 2004/38/EC Art 7 imposes conditions of residence on EU citizens residing in the host EU State for a period exceeding three months.

      Art 9 deals with the right of residence for a non EU family member of an EU citizen.

      With few exceptions, the majority of countries in the world, including the UK and Italy, take the position that a foreign national that is in it's territory for 183 days is deemed to be resident for tax purposes in that country. The UK, for example, additionally takes the position that a cumulative total of 90 days per year over a period of 5 years is deemed to be residency for tax purposes, but if there is accommodation available for that person's use, tax residency is deemed to exist from day zero. Quite what the position of the Italian Government is on "accommodation available for one's own use" is not for me to dig out

      There is, of course a double taxation treaty in existence between the Italian and UK Governments.
