    My sister and I both have POA for my father. I am hoping to buy his property in order to release funds to pay for his care home fees, and I I have got my property on the market. His property has always been willed to me but due to a shortage of funds, inheritance is no longer looking likely. I know that my father would be totally in support of my buying the property as it was always their wish for me to have it one day. However I have just been informed that because I have POA I cannot do this due to having a vested interest. Would the fact that my sister is also a POA help my case at all?

    If you want to buy your father's property yourself you need to apply to the Court of Protection for authority.
    I think the cost of application is around £350 and payable by the donor, your father.

      Thank you - is this fairly straightforward? Any ideas re. timescale? I'm just concerned that if we were to get a buyer for our house time might not be on our side...

        I did read that applications could take upto 6 months, but whether that was average or exceptional, before or after Covid I don't know.

        Give the OPG a ring, they might have more info available
