  • Cancer and PCP

    I purchased a new Volvo xc40 in November 2019. In March 2020 I was rushed into hospital and diagnosed with cancer and the car has not been used since then. I have now had my driving licence revoked for minimum of 2 years. With no driving licence and now no income (my job was a driver) I am in financial stress. Is there any way I can get out of the contract early?

    You might be able to rely on a legal doctrine called 'frustration' which essentially allows you to terminate the contract and walk away without liability where circumstances arise that prevent you from performing the contract. I would suggest you google the meaning as it will be easier to read than try to explain.

    Your alternative would be to exercise your voluntary termination right but means you will be liable to pay 50% of the total price payable under the contract.
