  • Drafting court defence Vs Excel parking - 2 minutes over grace period

    Hi,

I am looking for some advice re my case Vs excel parking.

This case dates back to 2016. I entered one of their carparks. Being unable to use online pay facilities and not managing to obtain change for the payment machine, from a nearby business, I left the carpark. I was in the carpark for a total of 12 minutes, overstaying the grace period by 2 minutes. I had completely forgotten about this as I thought it was a non event, not even realising the grace period rule.

I received zero correspondence from excel parking for 3 years, possibly due to moving address. I received a county court letter which I defended at the time due to not receiving any detail from excel and questioned the legitimacy of the claim. My concerns were multiplied when I received my first letter from excel claiming a CCJ had been made against me. This was confirmed not to be true by Northampton court.

Within mediation was the first time I received the detail / evidence of the event. As no agreement was made I now need to provide a defence to a small claims court. Any advice on where to start?

I see a lot of terms re 'Beavis' and also 'Jolly Vs Carmen' but am unsure how to context this kind of thing.

    Any advice would be appreciated.

    Thanks
