beneficiary died before estate had been finalised

Hi.
My brother passed away last Christmas and left some money. My other brother passed away 3 months later and had no money but had utilitie debts. Does the inheritance from the 1st brother have to go to pay off these debts? The debts exceed the amount involved?

Sorry to hear of your double loss.

Your second brother having passed 3 months after your first brother I don't suppose there was a survival clause coming into play.

.In which case your second brother's share of the estate would pass to his estate. That is, the gift to the second brother becomes part of his estate and so will be used to satisfy his estate's debts, taxes before any surplus is passed to any beneficiaries
