  • n244 dismissed

I recently made an application to the court to remove my CCJ, i have received a letter as they have dismissed my application on the grounds that the CCJ forms were sent to my 'last known address'.
Can i appeal this decision - i did not receive a court date or any correspondence from the court until this letter.
My CCJ was for a parking fine, the court documents were sent to a previous address, i had informed the parking agency of my new address.

You can, but whether you are successful is another story.

Did you have the application heard on the papers or was it a telephone or other type of hearing? Can't really comment on the prospects because you've not supplied any information.

If you want to appeal then the link below should assist you.

Hi, thank you for responding. The application N244 was filed in Court paper form in 2023 and further copies with exhibits were provided in January 2024 and filed in Court, I have proof of delivery I received an in-person hearing from the Court which I attended and only then because the Application was not put into the system the Judge dismissed the application. I wish to file a further application N244 with evidence showing the application had indeed been filed would this need to be filed under Part 23 of the Civil Procedure Rules
