Returning vehicle

I've just brought a vehicle from an approved dealer, 2018 plate and 5k on clock, after a day of driving noticed squeaky from rear, i looked under car and what i found was appalling, the car had obviously been sitting in a ditch the rust is everywhere

Anyway i want to "simply' return vehicle, the dealer has offered other cars in exchange and said the rust is just cosmetic so wont be refunding vehicle. i just cant trust them.

they have said they would go to court other this matter. am i missing something here or are they just hoping i will just roll over.

If you do initiate a court claim you will have to prove the vehicle is unsatisfactory.
Perhaps an independent engineer's inspection would be a worthwhile investment

You do not say how much you paid for the vehicle, but price has to be taken into account when deciding what is or is not satisfactory.
If purchased on finance you must keep the finance house informed, as it is their car.
