Who owns the materials ??

I employed a local company to install a driveway. The standard of workmanship was so bad that I refused to pay. The matter went to the small claims court where the claims of the company, and my claim for legal expenses and renovation costs were all dismissed. The judge also refused an appeal. In the original Terms and Conditions of the installing company it states that they have ownership of the materials until the invoice is paid. As I will not be paying the invoice will they still retain ownership - can I legally dispose of the badly installed driveway in order for another contractor to install a new one ??
