  • What else I can do if my conveyancer is not working?

    I'm in the process of buying my apartment. The instruction has been started for a little more than 2 months. Within the first week of instruction I got my mortgage approved. The apartment I'm buying is basically vacant now that I can move in at any time. Neither me nor the seller has any issues. I did the whole building survey.

    During the 1st many days the conveyancer didn't do anything. On the 10th day my documents are first viewed (they have a system telling you when a document is viewed).

    Later the search started that finished within 1 week. But they let it sit there for 3 whole weeks. Only until the seller side complaint that legal process has not and cannot start at all on their side as my side communicated zero they start to read the search and draft enquires.

    After this complaint 1.5 months after the instruction my solicitor started to ask the seller side and bank for documentations etc. The seller side prepared 2 documents within 1 week. 8 days again passed my solicitor has not processed those 2 documents at all.

    It is a bit cynical but true to say every system is corrupt, but this is too much. My previous home in Hollands this get done within a week and it is legally binding. I could not understand how lawyer can treat clients interest like this. The seller can sell to anyone else in this situation and I need to pay my high rent to my landlord plus 2 month notification period that I cannot even notify.

    They know the game: Slowness and bad communication is not negligence. And my bank already instructed them as well. If I fire them it get even slower. And I cannot guarantee the next solicitor can be that good to do it all over again and save enough time finish it. Theirs is a company not small. If this is something else I would have fired them already even it means I end up paying double and slower. It needs to be done right (in the right attitude as well).

    Any idea what else I can do to help my situation?

    If you have already complained to the file handler, complain to the practice manager
    The complaints procedure will be set out in the terms and conditions you should have received when you appointed them.
    . Tell the practice manager that you want your file moved the the most proactive member of the conveyancing team.
