  • Problem with a puppy

    Hi. A customer purchased a pedigree Cairn Terrier from me recently. A recognised puppy contract was used. On Sunday evening the customer spammed social media (FB) with offensive messages claiming that they are unhappy with the purchase stating considerable erroneous claims that amount to libel. Thecustomer has not approached me direct with any such claims. I believe that puppies are considered as good under the 1979 Sale of Goods Act? I intend to send a letter offering a full refund for the puppy even though the time exceeds 30 days now. Presumably if they choose not to refund then they cannot continue make such claims? Do I have any rights under the Act to request the return of the puppy so that it can be 'repaired', which of course would not be able to be achieved but it would mean that the puppy would be returned. I am now concerned for the welfare of the puppy.

      Assuming you are a responsible breeder, I suspect your main concern is the puppy you have just sold.
      Other than writing as you propose, there is nothing to be done.

      I don't understand why the purchaser should start making defamatory statements before contacting you.
      Presumably you told them that if there were problems, or they couldn't look after the puppy they should in the first place contact you.
      Unless you can show the pup has been mistreated, or the buyer has substantially breached the contract, I doubt you can force return of the puppy.

      IMO best approach is a conciliatory (but not grovelling) letter explaining that if they are having problems or changed their mind you are willing to buy back the puppy
