Hello everyone, I have recently joined this great forum. I really really need help with removing/setting aside Default Cost Certificate issued by Uxbridge County Court.
First of all, I don't know if Default Cost Cert and CCJ are the same.
Here's the timeline.
1. Default Cost Certificate for £23k issued by Uxbridge County Court in Sep 2018 and sent to our old address which I was never aware of.
2. We had moved out of that address back in 2015 and have proof of address like bank statements etc.
2. I came to know about it in May when I was sent a copy of the same at current address by the solicitors who put it on my record with Interim Charging Order on my house.
3. I immediately made reconsideration request to the court advising I was never aware of the this and that they should remove it etc. that's pending the hearing.
4. I then approached the claimants to negotiate and finally managed to agree reduced amount of £18k and paid off in full.
5. They have signed Consent Order as well to remove the Default Cost Cert/CCJ from the register of Orders, Judgments and Fines (Attached)
Where do I go from here?
Do I write a covering letter for the court asking to remove with Consent as it was sent to old address and hence was unable to defend or address the issue?
Court Helpline said I need to pay £100 with this.
Do I fill N244 and put down reasons why it should be removed?
Covering Letter I have drafted is:
"Date: 18-08-2020
Claim no. XXXXXXX
Watford County Court
3rd Floor, Cassiobury House,
11-19 Station Rd,
Watford WD17 1EZ
Re: Removal of CCJ (Default Cost Certificate)
Dear Sir/Madam,
Please see the attached Consent Order for the court to seal, signed by both the parties to remove the County Court Judgment (Default Cost Certificate) registered against the us on the Register of Judgments, Orders and Fines dated 17 September 2018 as the default cost certificate was sent to the wrong address, even though I gave the defendants and the court the correct one, denying us a chance to defend ourselves.
Thank you"
Just need to know what do I do...! Please help. I have seen lot of people doing it themselves and solicitors ripping off with £700-£800 for something I am sure is very straight forward ONLY if I know the right way of doing it.
I have seen a guy called Rob is helping a lot.
