    Good evening everyone,

    I hope that someone on here will be able to assist with some advice as I really don't want to make a mistake insofar as plans I'm making, the reason will become apparent soon.

    My wife of thirty years hit the menopause just over year ago, we're both aged forty nine.

    Anyhow, after a great deal of anger (on her part) hatred and mixed emotions she left home a couple of months ago, she's now in the process of moving into her own place after staying with family.

    As you can imagine the family home needs to be sold and I'm making some good headway on this, and given this is only the second property we've ever owned, and we moved into this fifteen years ago, I'm a little ill informed as to the final process in terms of the day of completion.

    What I need to know is if I will be required at any stage on the day, in fact, I can be more specific.

    Would I need to be contactable for the deal to be completed, or can I take it that baring a major screw up with the solicitors, I won't be needed. Given the sensitive nature of my plans I can't ask my own solicitor given I don't want any questions being asked.

    Now. The reason this becomes so pertinent is that I'm not prepared to see the last part of my life with this wonderful woman come to an end, I know that there's no one else involved on either side, this is purely a hormonal imbalance that's made her see the world from a weird perspective, so it's a bit unique insofar as I don't hate her, nor is it I don't want her, she just went a bit crazy and closed down.

    Obviously I'm seeing things with a very clear head, in fact I'd consider that certainly sound of mind, maybe I'm over simplifying it a tad, nonetheless, on the day that the completion, let's say at noon, I plan to kill myself before the house get's physically transferred, so technically I would still own it, I can't bear the thought of someone else owning it and my life with her coming to an end, but I've held it together thus far but I just want done with it now.

    In any case. form my perspective I'm neither prepared to live without her, or lose the house and the life I had in it, preferring to go with the memories I have, obviously I won't be doing it in the house, can you imagine what the poor buyer would think?

    Suffice to say I'd do it tonight but I don't want to burden my wife with having to deal with the fallout of my death and then have to sell the house etc. that wouldn't be fair on here or the kids, whom are old enough to deal with it in their own way.

    So, my second question is this, what would be the result if it came to light that I had indeed died before the physical completion, could there be any fall out? Or would I be better off doing it in such a way that I wouldn't be found for a day?

    I've already written the email and set this to be sent "after" my death to make it look like I was still on this mortal coil when the deal was done, obviously I'd like to be found fairly quickly as the thought of my family not knowing where I was doesn't do it for me either.

    Needless to say that I've made plans to slow the temperature by which my body would cools so the exact time of death would be harder to prove, typically a body will cools at around 1.5oC per hour.

    Allowing for my plans, having a heater in the room that increases the temperature, this is going to be on a timed switch that tuns off after two hours, this added with the fact that I plan to move my watch forward by two hours, then stop it, will again support my death as being two hours later.

    With the above I should be able to ensure that the estimated time of death at least two hours after the deal was done, so the watch, the body temp and the email should all denote est. death time of around 14:00.

    Now I know quite a few of you will say I should just wait and do it after, or maybe even not to do it at all (this ins't an option as I'm resolute), but let's say I was to wait, if the deal had been done then this would defeat the object of me doing it whilst I was still technically the owner of said property, hopefully this makes sense.

    In any case, any and all advice to this question would be greatly appreciated.

    Welcome, and sorry to hear of your situation.

    Regarding your specific query if a property owner contracts to sell but dies before completion the land and the rights & obligations under the contract to sell pass to his personal representative(s) under sec 1 &3 of the Administration of Estates Act 1925.
    So there is no need for an elaborate charade.

    And just to add that if the house is owned as joint tenants on your passing it will automatically pass to your widow by right of survivorship

      No need to say sorry, I had a great twenty eight and a bit months with her.

      Your advice sounds perfect, would it make a difference that the house my name only?

      Presumably I could get on with my plans after exchange and the date of completion is set.

        Whilst the house is legally owned by you, your wife will have a beneficial interest in it., but legal ownership will not automatically pass to her.

        I assume she is aware the house is for sale, and there is some arrangement for some of the proceeds to pass to her.

        If you die before completion but after exchange the sale would continue (even if possibly slightly delayed) and your representative (executor) will see to its completion and then deal with your estate

          Yes, she is aware of the sale, and given that it's our 30th wedding anniversary on the 20th of this month the advice just's helps me finalise my plans.
