  • Whistle Blowing

    A friend of mine works in Retail and he is about to go through a disciplinary hearing with an employee who is short service. She has now raised a grievance claiming the manager has been bullying and harassing her along with other allegations including discrimination, duty of care, breach of health n safety.

    The manager cant think of any reason but one concern is that as a Company they keep nationality statistics/reports to ensure there is diversity in the workforce.

    1. Is this a legitimate reason to store and report this data?
    2. If this is not a legitimate reason then could the employee have grounds for Whistle Blowing and who would she report this to? The employee has not raised this in her grievance explicitly but has made a point "unethical behaviour".
    3. What would be the worst case scenario in terms of what she could potentially claim?
