  • Is my employer intimidating me?

    Hi,

please can you advise me on what you make of my case and my employers actions towards me.

long story sort, my employer has not paid me my wages. Technically they have but they have requested it back and I refused. They claim I gave my verbal consent that I said I do not want to be paid. I told Acas this is not the case.I plan on making a breach of contract case. The employer then came back to say I gave the consent in writing. I did not ask for this proof. I’m not sure if I am allowed? They ended my contract back in June over the phone. They are now saying they did not end it. I believe this is one of their tactics, they know I can’t make a claim for breach of contract if my contract has not ended to the tribunal .but ultimately by saying my contract has not ended, I can say they have not paid me during June and July and increase the money they owe me( my contract has no unpaid leave clause). I have not been asked to return to work for my normal duties. What do you think ?

anyway my employer has today emailed to say they agree to a drop hands agreement in which they will end the contract and this is the concerning part, give a factual reference. Is this normal in drop hand agreements - to include factual references. I believe they are just threatening me, they are part of a larger company that owns the UK industry I am employed in.

am I rational in thinking they are intimidating me or is this usual ?

any help will be greatly appreciated.

    thanks
