    Hi, my daughter has received a court letter for a pay day loan (Perch Capital/TM Legal services £255.23). She took multiple loans over a period of a year or so but has no idea with whom, or how much a this stage. She was not working through the whole of this period and was depressed, suicidal and in a relationship with a drug dealer who coerced her to borrow money. She is unable to psychologically deal with any of this so I am trying to deal with it on her behalf.
    I will acknowledge the claim and request the extra 14 days as recommended by your guide but do not know how to find out any more. Did the company/companies fail to complete due diligence in checking her ability to repay? Is her mental health evidence that she was mis-sold these loans? Where do I start please?

    Acknowledge the claim, SAR to Perch Capital and letter to TM Legal Services demanding copies of all the documents they intend to use in court in order to narrow the issues between you, as expected by the courts. You expect these by return or in any case within 7 days.

      So I have a letter for Perch Capital requesting a copy of the credit agreement and a letter to TM legal asking for the documents they mention which includes the credit agreement, notice of assignment and letter of claim.
      How can a prepare for the defence while I wait for these? I have discovered my daughter was not employed (or receiving any benefits) when she took out the loan - is that evidence she was mis-sold ?
