  • Private seller taking them to court.

Hi I recently brought a car from a private seller had a look around the car all seemed fine looked on the log book he was selling it 20 miles from the adress we was at I thought was abit suspect but thought he could selling it for someone else as the person we paid the money into the bank account was not the name in the log book. He then tried selling it to us more than the advert which we said it's not advertised for that much then we got in the car it had 2000 more miles on it than advertised, we signed the log book over all that then got 40 miles down the road the car shot up with engine warning light and oil pressure light and misfire in cylinder 3 and sounded rough as anything tried to ring the bloke from auto trader and he took the add down so we clearly couldnr ring him, the add stated in it ALL MECHANICALLY WELL AND NO FUTURE REPAIRS NEEDED, well i took it to a garage and they said to me that car is pretty much buggered had serious engine issues and engine wear and is a massive money pit and that they would of cleared the codes before they gave it to us to stop the rough riding of course we all know that you can do stuff I was thinking can I take them to small claims court for not matching the vehicle to the correct description tried for reason the guy and all he keeps doing is messing us around we also found out the guy who took the money into is account was also no inact the payee we paid the bank into intact he was the mot tester that he got an mot of that day all seems like they have sold it from the garage but under private seller because they knew the car was a wreck paid 2860 for it.

It is likely you will be throwing good money after bad unless you know the real name of the person or company, their address to serve the claim form and whether they actually have any assets or money to repay the debt.

Unless you know you can recover the money, it might be a waste of time and i would write it off as experience.

Seems to me there were too many red flags you mentioned in your post you really should have asked questions. The AA has a useful checklist on buying a car privately and in particular there's a section on documents.

If you have a question about the voluntary termination process, please read this guide first, as it should have all the answers you need. Please do not hijack another person's thread as I will not respond to you
