  • Beneficiary empty house

I have a story that's very sad being a beneficiary, Having a life changing situation on top of that grief with mum passing away, and money in mums bank accounts spent.
A joint bank account, on mum's death, the money by law goes to the account holder.
BENEFICIARY sibling that ran to a solicitor claiming fraud for contentious probate,, claiming she's an executor and taking control when mum died intestate,
Emptying mums house sending it all to the tip, changed the locks herself kept the keys wouldn't let no one in the house, to grieve or give any family members their right to say their final goodbyes, on the day of emptying the house siblings were their grandchildren were there.

The sibling who wanted all this power, can you believe rang the police. Rang the police, caused grandchildren to be crying, sibling and grandchildren distraught.

Its absolute craziness at the worst time of your life when you need compassion empathy together as a family, it was all taken away by one family member who's took everything in their hands and acting as if they have the power.

A caveat has been placed, too stop the sibling who wants power to get probate, as its shameful sad and a very lonely time for me, listening to my other siblings loss dealing with my own loss and the fact that a family member wants to buy my mums house and this person who wants control of everything has taken away the right to access the house, to grieve to maintain it and the caveat comes off and I tried to get access by changing the locks but the sibling doing all this sent police to my door ordering the keys to be given back. Otherwise I would be arrested.

The caveat comes off in a week. How do I proceed with her lack of empathy feelings too all concerned, and the fact that the solicitor and the sibling acting as she's got all the power, wants us other 3 siblings to pay the solicitor bill out of the sale of the house, when she's done nothing but cause Chaos with her own intentions.

I would really appreciate advice please in gratitude Thankyou.

Sorry to hear of your problems, but there often seems to be one in every family.

The caveat can be renewed, cost £20 (I think) for another 6 months.

Police should not have allowed themselves to get involved as this is a civil matter (unless it would lead to a breach of the peace)

The sensible way forward would be by talking with the awkward one, but if she will not engage that won't be an option.

Anyone of you, or all of you jointly, can apply for probate.
However it is done, the strict rules regarding intestacy must be followed when dealing with the estate, and a strict accounting has to be kept.
Any deficiencies can be challenged in court, so your sister might already have potential problems if she has disposed of your mother;s chattels.

It might be worth consulting a solicitor who specialises in contentious probate to see what your options are.
A single fixed fee limited consultation perhaps
