  • Case law a bank uses on an overdrawn joint bank account when one holder dies

    As above.
Used to work in a bank many moons ago and we were told of a legal case that meant that a joint account which was overdrawn had to be frozen until the estate of the deceased could be sorted to reapay the debt.
Just cannot for the life of me remember the name of the case.

Are you sure thats still the case? I am under the impression the surviving owner of the account becomes so owner on the basis that the account is treated as joint tenants and the principle of survivorship.
