  • Highview parking ticket

    Hello there

I wondered if anyone could help me. I've received a parking ticket from Highview Parking for £100 (discounted at £60) in the post. It wasn't me driving the car at the time, am I able to appeal this without having to give my friends details who used my car for the day? They also didn't 'invite' me to offer the details of the driver but stated I 'should' provide the details. Which I assumed went against the POFA? I'm a little confused as to whether or not I can appeal the ticket. Any advice would be welcomed

Post up the redacted NTK but leave dates. Then we can all look.

    here's POFA, you need paragraph 9 https://www.legislation.gov.uk/ukpga...dule/4/enacted

The NTK fails to meet the requirements of POFA in many ways and therefore they cannot transfer liability to the driver but I can't read the back page.

      Dear Sirs,

I have just received your Notice to Keeper xxxxx for vehicle VRM xxxx

You have failed to comply with the requirements of Schedule 4 of The Protection Of Freedoms Act 2012 namely, but not limited to, failing to give notice of keeper liability as prescribed by section 9 (2) (f) of the Act. You cannot, therefore, transfer liability for the alleged charge from the driver at the time to me, the keeper.

I was not driving at the time and as there is no legal requirement to name the driver I will not be doing so.

I do not expect to hear from you again, or your debt collectors, except to confirm that no further action will be taken on this matter and my personal details have been removed from your records.

      Yours etc

If online then take screen shots at every stage.

This is well winnable at POPLA when you add in all the other fails
