  • Which body oversees professional radiologist?

    Which professional body oversees radiologist who give professional opinion to the court?

    Who would I write to to clarify if a professional radiologist has over stepped the mark in his report to the court ?

      I suspect he should have reported his findings on the scan then left the defendant’s orthopaedic expert to make a clinical diagnosis ? However he has reported his findings and then provided a clinical diagnosis. Is it possible to have his diagnosis which I suspect is wrong, which my orthopaedic expert thinks is wrong, removed from the report ?

        You can challenge his diagnosis, but bear in mind he will be a qualified doctor who has done a couple of years specialty studies (perhaps in orthopaedics.
        You will need another professional to produce a contrary report.

          Thanks, I will read through the link. I don’t wish to contest his radiologist opinion, it is the fact he has made a clinical diagnosis without being aware of all the medical history of performing a clinical examination?

                I've just skimmed quickly over your past threads, and noted that the report was commissioned by yourself, and you were ordered by the court to pass it over to the other party (insurance company?), so it seems the expert is not covered by CPR 35, and is really only a witness.

                I think it's a case of obtaining a contrary "expert" report, and having that radiologist in court as a witness to destroy his clinical diagnosis.

                  No this is a radiologist report commissioned by the defence which expresses a clinical diagnosis without access to medical records, velocity of accident, alternative diagnosis made by orthopaedic experts in reports to the court.

                  so the question really is , should a radiologist when providing reports on MRI scan provide a report only on what they find on the scans ? Would they be stepping out of the correct procedure by offering a clinical diagnosis without carrying out a clinical examination or having access to the whole clinical records of symptoms?

                    1.Should the radiologist have made a clinical diagnosis or provided the orthopaedic experts with a report on the findings then the orthopaedic experts can produce the clinical diagnosis ?

                    2. Has the radiologist by reporting the findings confined himself initially to his area of expertise, but has he then stepped out of his area of expertise, by expressing a clinical diagnosis In his conclusion without first having access to all the clinical information the orthopaedic experts have in front of them ?

                    3 The upshot is the defendants orthopaedic expert has agreed with the radiologist clinical diagnosis ( even though it is highly unlikely to be correct).The claimants orthopaedic expert has strongly disagreed with the clinical diagnosis of the radiologist.

                    4 . So the 64 million dollar question is can the radiologist be forced to remove the clinical diagnosis from his report?

                      My limited understanding is that radiologists do make clinical diagnosis on the basis of the scans.
                      However normally they need to be taken in conjunction with the diagnosis made by the ordering clinician.
                      So your orthopaedist should be able to dispute the radiologist's report

                      Crossed with your last post, and in view of the additional information I don't see you being able to have that report redacted.

                        Well thanks for the help. I spoke to another radiologist this morning who said that without all the relevant clinical information the defendant’s radiologist should not have provided the clinical diagnosis. He should of reported the findings on the scan and the orthopaedic surgeons should then of provided the clinical diagnosis!

                        So how do you challenge the clinical diagnosis and request the court to instruct the radiologist to redact his clinical diagnosis?

                          There's been a plethora of 'experts' recently who seem to be overstepping their mark or authority when it comes to reports. The Civil Litigation Brief website has lots of recent case law on experts if you do a search on there you might find something helpful. I don't see any reason why it isn't possible for an expert to make a comment/diagnosis based on the evidence provided before them but I think that depends on the situation and whether a second medical is required/needed based on the dispute.

                          All experts have a duty to the court and if the report is based solely on evidence presented without carryig out a medical then the report should explicitly state this and the source of information. Otherwise, credibility and acceptance of what is written by the expert may be doubted by the court

                            thanks for that I will have a read of the link. Is there any governing body of expert witness radiologists, to whom I could make a complaint ? The radiologist have provided a clinical opinion without having sight of medical records or previous orthopaedic opinion in the case.

                              When people challenge doctors' diagnoses, they are in a very difficult position. Firstly, because you are not a doctor and cannot know all the subtleties of the diagnosis made to you or your relative. Secondly, you will not be able to argue with a person who has a medical education yourself, because you may not understand the terminology that he uses in his vocabulary. Thirdly, in this case, you should consult with two other specialists in this field. For example, visit another orthopedic clinic like cameronmch.com which can help you deal with the problem.
